1. Acceptance of Terms

By downloading, installing, or using the VIBE: AI Video Generator application (the “App”) or visiting the website at www.aivideoking.com (the “Website”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Rocket Digital Limited (“we,” “us,” or “our”).

If you do not agree to these Terms, you must not use our services.

3. Description of Service

VIBE is an AI-powered video generation platform that allows users to create videos from text prompts (text-to-video) and images (image-to-video) using multiple third-party AI models. The App is available on iOS and Android devices. We provide access to AI video generation models including, but not limited to, Kling, Sora, Google Veo, Seedance, and WAN.

4. Eligibility

You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

5. Account Registration

Some features of the App require account registration. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

6. Subscriptions & Payments

The App offers both free and premium (VIBE Pro) tiers. Subscriptions are managed through the Apple App Store, Google Play Store, and RevenueCat.

  • Free tier: Limited access to AI models and generation credits.
  • VIBE Pro: Full access to all AI models, faster generation, and additional features.
  • Billing: Subscriptions are billed on a recurring basis (weekly, monthly, or annually) through the respective app store.
  • Cancellation: You may cancel your subscription at any time through the app store settings. Cancellation takes effect at the end of the current billing period.
  • Refunds: Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies.

7. Content Moderation & Safety

We are committed to providing a safe and responsible AI video generation experience. The following content moderation measures are in place:

7.1 Automated Safety Filters

All text prompts and uploaded images are processed through automated safety filters before being sent to AI generation models. These filters are designed to detect and block content that violates our policies. Prompts or images that trigger safety filters will be rejected, and the generation request will not be processed.

7.2 Prohibited Content

You may not use the App to generate, attempt to generate, or distribute content that:

  • Depicts sexual exploitation or abuse of minors (CSAM) in any form.
  • Contains non-consensual intimate imagery or deepfakes of real individuals without their explicit consent.
  • Promotes terrorism, violent extremism, or incites violence against individuals or groups.
  • Contains explicit sexual or pornographic content.
  • Promotes self-harm, suicide, or dangerous activities.
  • Constitutes hate speech targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Infringes upon the intellectual property rights of third parties.
  • Is intended to deceive, defraud, or mislead others (including deepfakes intended to deceive).
  • Violates any applicable law or regulation.

7.3 AI Model Safety Measures

The third-party AI models integrated into VIBE (including those provided by OpenAI, Google, and others) have their own safety filters and content policies. These model-level filters operate in addition to our own moderation systems. Some prompts may be rejected by the AI model provider even if they pass our initial filters.

7.4 Reporting & Enforcement

  • Users can report content or accounts that violate these Terms by contacting us at hello@rocketdigital.ai.
  • We reserve the right to review, remove, or disable access to any content that violates these Terms.
  • We may suspend or terminate accounts that repeatedly or egregiously violate our content policies.
  • We cooperate with law enforcement agencies when required by law and may report illegal content to the appropriate authorities.

7.5 Limitations of Content Moderation

While we employ multiple layers of content moderation, no automated system is perfect. If you encounter content that you believe violates these Terms, please report it immediately. We continually work to improve our safety systems.

8. User Content & Intellectual Property

8.1 Your Content

You retain ownership of the text prompts and images you submit to the App. By using the App, you grant us a limited, non-exclusive license to process your content for the purpose of generating AI videos and operating our services.

8.2 Generated Content

AI-generated videos created through the App may be used by you for personal and commercial purposes, subject to these Terms and the content policies of the underlying AI model providers. You are solely responsible for ensuring that your use of generated content complies with applicable laws and does not infringe on the rights of others.

8.3 Our Intellectual Property

The App, Website, and all associated trademarks, logos, designs, and software are the property of Rocket Digital Limited and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our services.

9. Acceptable Use

In addition to the content restrictions in Section 7, you agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to circumvent, disable, or interfere with safety filters or content moderation systems.
  • Use automated systems, bots, or scripts to access the App or generate content in bulk without our authorization.
  • Reverse-engineer, decompile, or attempt to extract the source code of the App.
  • Interfere with or disrupt the integrity or performance of the App or its servers.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Use generated content to create misleading news, disinformation, or deceptive media.
  • Resell, redistribute, or sublicense access to the App or its AI generation capabilities.

10. Third-Party Services

The App integrates with third-party AI model providers (including OpenAI, Google, and others) and third-party services (including Firebase, Google Cloud, AppsFlyer, RevenueCat, and Google AdMob). Your use of the App is also subject to the terms and policies of these third-party providers. We are not responsible for the practices or content of third-party services.

11. Advertisements

The free tier of the App may display advertisements served by Google AdMob. Advertisements may be personalized based on your usage data and device information. You can opt out of personalized ads through your device settings.

12. Disclaimer of Warranties

The App and Website are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We do not guarantee uninterrupted or error-free service.
  • AI-generated content may contain inaccuracies, artifacts, or unexpected results.
  • We do not guarantee the availability of any specific AI model at any given time.
  • Generation quality and speed may vary depending on server load and model availability.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Rocket Digital Limited and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the App or Website.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or HKD 500, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

We may suspend or terminate your access to the App at any time, with or without cause, including but not limited to violation of these Terms or our content moderation policies. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will survive.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
